Because the cluster does not and can not know they are down, nor that they are supposed to be down.
They are added to the CIB so that they can be fenced and put into a known state.

As long as even one node remains online this knowledge will be preserved and they will not be re-fenced.

The behaviour you were relying on is inherently inconsistent and dangerous.
It can only occur if the node has never joined the cluster (ever) or you're fiddling with the on-disk CIB before starting the cluster (in which case the node could be online but unreachable and hosting services).
